APPLICANT REQUESTS THAT:

His 17 Oct 12 Fitness Assessment (FA) be declared void and removed from the Air Force Fitness Management System (AFFMS).

APPLICANT CONTENDS THAT:

He had a medical condition which prevented him from passing his 17 Oct 12 FA.  On 2 Oct 12, he was diagnosed with colitis and should not have been tested. 

The applicant’s complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

The applicant served in the Regular Air Force as a technical sergeant during the period of time in question.  

The applicant’s last five FA results are as follows:

According to the memorandum from the Brooke Army Medical Center (BAMC) Gastroenterology Clinic provided by the applicant, he was diagnosed on 2 Oct 12 with moderate to severe active ulcerative colitis at BAMC.  His physician stated the applicant “should be on a profile starting 2 Oct 12.  Patient should be excused from any physical activity such as running for greater than 100 yards, sit-ups, or push-ups.  Also no lifting over 10 pounds and no forced physical training.  Unable to complete electronic profile at this time but currently in process.”

The remaining relevant facts pertaining to this application are described in the letter prepared by the Air Force office of primary responsibility (OPR) which is included at Exhibit C.

AIR FORCE EVALUATION:

AFPC/DPSIM recommends denial, indicating there is no evidence of an error or injustice.  AFI 36-2905 notes “Medical provider will sign AF Form 108 if member is referred for medical evaluation following an Unsatisfactory score.  Members with unsatisfactory scores may be scheduled for a medical evaluation to determine if there were possible medical indicators that prohibited program success.”  The applicant did not provide evidence to substantiate his claim; specifically, an AF Form 108, Physical Fitness Education and Intervention Processing, and/or memorandum endorsed by a medical provider and unit commander indicating a preexisting condition that contributed to his FA failure.  While the applicant enclosed a statement from his medical provider identifying the existence of a medical condition, the physician’s recommendation only reflects no running, no push-ups, and no sit-ups.  The applicant was not recommended for an exemption for abdominal circumference (AC) measurement.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 17 Feb 13 for review and comment within 30 days.  As of this date, no response has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law or regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice.  After a thorough review of the evidence of record and the applicant’s complete submission, we believe a preponderance of the evidence supports corrective action.  While we note the comments from AFPC/DPSIM indicating the applicant did not provide evidence to substantiate his claim, we believe the documentation submitted by the applicant, specifically, the memorandum from the BAMC Gastroenterology Clinic stating that he should not have been allowed to take the FA due to his medical condition constitutes sufficient evidence to warrant corrective action.  Therefore, we recommend the applicant’s records be corrected as indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that he was exempt from the cardio, push-up, and sit-up components of the Fitness Assessment (FA), dated 17 October 2012, resulting in an overall excellent rating.
